Importing a used injection molding machine into India
The Chartered Engineer Certificate: what it is, who issues it, when it has to be issued, and what customs does with it.
The short version
India generally permits the import of used capital goods without a strict age cap, but a consignment of second-hand machinery is normally expected to be accompanied by a Chartered Engineer Certificate (CEC) issued at the port of loading โ that is, before the machine ships.
The certificate is an independent engineer’s statement covering the identity and condition of the machine and, importantly, an opinion on its value and residual life. Customs use it to satisfy themselves that the declared value is reasonable and that the goods are what the invoice says they are.
Timing is the trap. The certificate is expected to be issued at the load port, on the actual machine, before shipment. Trying to arrange it after the container has sailed is where importers lose weeks and pay demurrage.
What the certificate typically covers
- Identification of the machine: make, model, serial number and year of manufacture, verified against the machine plate.
- A description of condition and an opinion on residual working life.
- An opinion on the fair value of the machine, which supports the declared transaction value.
- Confirmation that the goods correspond to the invoice and packing list.
- The engineer’s credentials and the place and date of inspection.
Because the certificate speaks to value, it is worth making sure the invoice, the contract and the machine are consistent before the engineer attends. A discrepancy discovered at that point delays the shipment; a discrepancy discovered at the Indian border is much worse.
A realistic sequence
- Confirm the requirement and the acceptable certifying bodies with your Indian customs broker (CHA) in writing.
- Agree in the contract who arranges the CEC inspection, who pays for it, and what happens if the machine fails.
- Have the engineer attend at the seller’s premises or the load port, on the actual machine, before it is packed.
- Check that the machine plate details on the certificate match the contract, invoice and packing list exactly โ model, serial, year.
- Ship with the certificate in the document set, and send scans ahead to your CHA.
- Confirm the correct HS classification (heading 8477.10) and duty position, including IGST, with your CHA before the deposit.
Where a supplier arranges the inspection routinely, this adds days rather than weeks. Where it has to be organised from scratch, allow more.
Questions
Common questions
Is there an age limit on used machinery into India?
There is no strict general age cap for second-hand capital goods equivalent to Vietnam’s ten-year rule, which is why India is an accessible market for older machines. That said, the certificate speaks to residual life, and both your bank and your own economics should care about age even where customs does not. Confirm the current policy position with your CHA โ trade policy is revised periodically.
Who can issue the certificate?
A chartered engineer or an inspection body accepted for the purpose at the port of loading. Major international inspection companies provide this service in China routinely. Your CHA will tell you what is currently accepted at your port of entry.
What if the declared value is questioned anyway?
It happens, and the certificate is your first line of defence. Keep the contract, the proforma invoice, the payment records and the inspection report together and consistent. A well-documented arm’s-length transaction with an independent valuation behind it is far easier to defend than an invoice alone.
Before you rely on any of this
Import rules change and are enforced by your own customs authority, not by the seller. Everything on this page is a starting point for a conversation with your licensed customs broker โ confirm the current requirement in writing before you pay a deposit.
